GP FOR IRRIGATION COMM AREA DEV The Court made the following: 3 VS,J W.P.NO.9221 OF 2024 ORDER:- The present Writ Petition came to be filed under Article 226 of the Constitution of India seeking the following relief:- “...to issue a writ of mandamus or any other appropriate writ or direction declaring the action of the Respondents in withholding the payment of Rs.24,60,232/- even after finalizing the bills, payable to the petitioner in relation to the work i.e., Providing inspection Road with BT from KM 146.000 to KM 147.200(plus) 0.580 on Left side bank of S.S.G. Canal vide Agreement No.33SE/2016-1 7, Dt.03.02.2017 is questioned, as the same is illegal, arbitrary and consequently direct the respondents to consider for payment of Rs.24,60,232/- with interest 12percent per annum for the delayed amount to the petitioner in respect of execution of above- mentioned work forthwith and pass....” 2. Heard learned counsel for the petitioner and as well as learned Assistant Government Pleader for Irrigation. 3. Today, when the matter is came up for hearing, the learned Assistant Government Pleader for Irrigation furnished a copy of the written instructions issued by the Executive Engineer, (FAC), NTR TGP Division Srikalahasti, vide letter No.EE/NTR TGP DIVN/SKHT/AB/A2/Court Case/365, dated 10.07.2025, wherein it is stated that the first and part bill and second and part bills were paid to the contractor. The third and final bill has been prepared for an amount of Rs.23,17,527/- and is ready to be uploaded on the CFMS Portal. However, the Government has recently instructed to present the bills in Nidhi Portal instead of CFMS Portal. There is a delay in uploading the same, because of certain issues being faced in uploading the bill in Nidhi Portal and the bill could not be processed. It is also further stated that these issues are 4 VS,J W.P.NO.9221 OF 2024 already brought to the notice of higher authorities and the issues will be resolved shortly. 3. In view of the fact that the amount payable to the petitioner is admitted, instead of keeping this writ petition pending, this Court feels it appropriate to dispose of the writ petition by directing the respondents to pay the bills to a tune of Rs.23,17,527/- as expeditiously as possible, preferably within a period of three (03) months. 4. Accordingly, the writ petition is disposed of. There shall be no order as to costs.
