1. This Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, ‘BNSS’), has been filed by the Petitioners/A.2 and A.4, seeking anticipatory bail, in connection with Crime No.34 of 2025 of Sri City Police Station, Tirupati District.

A case has been registered against the petitioners/A2 and A4 and other accused for the offences punishable under Section 329(3), 126(2), 109(1), 351(2), 79 r/w.3(5) of Bharatiya Nyaya Sanhita, 2023 (for short, ‘BNS’). The prosecution’s case, in brief, is that on 14.03.2025, at approximately 11:00 A.M., at Survey No. 18/2, near HIT Circle, Sri City, Tirupati, the defacto complainant serving as the Deputy Security Manager at Sri City, was

2 supervising the ongoing development activities, including the erection of cement poles and iron fencing, along with his staff. During this accused persons A1 to A5, residents of Thonduru Society Village, allegedly trespassed onto the lands of Sri City. They are said to have wrongfully restrained the complainant and his staff. In furtherance of a premeditated plan and with the intention to kill the complainant, it is alleged that A1 poured petrol on him and instigated A2 to A5 to act against the complainant as “veellani champithegani mana joliki verevaru evaru raru” and to set fire to him, abused the women security supervisors in filthy language and threatened them with dire consequences and that they will see their end. Consequently, the present case has been registered against the petitioners and other accused.
Learned counsel for the petitioner/A.2 and A.4 submits that A.2 is the wife of A.1 and A.4 is the wife of A.3, and in this crime, A.1, A.3 and A.5 were remanded to judicial custody and they were released on bail as per the orders dated 28.03.2025 in Crl.M.P.No.56 of 2025 passed by the learned XII Additional District and Sessions Judge, Chittoor at Srikalahasti. Learned Assistant Public Prosecutor, for the Respondent-State opposed the grant of anticipatory bail to the petitioners/A.2 and A.4. I have heard both sides. 7. A perusal of the material reveals that the accusations against the petitioners and other accused are based on an alleged plan to kill the complainant. Specifically, it is claimed that the petitioners, with the intent to kill the complainant, poured petrol on him and instigated A2 to A5 to set him on fire. However, it is not the prosecution's case that petitioners A2 and A4 actually poured the petrol on the complainant, nor is it claimed that the complainant was set on fire. It appears that the present case arose due to civil litigation between the parties concerning property disputes. When ascertained, the learned Assistant Public Prosecutor submits that no criminal antecedents have been reported against the petitioners, except the present process. 4. 5. 6. case. 3 1 have gone through the orders passed in CrI.M.P. No. 56 of 2025, which indicate that the Sessions Court was pleased to grant regular bail to A1, A3, and A5, observing that the investigation was nearly complete and that only the filing of the charge sheet remained. Given that the material on record shows the investigation is concluded, the release of the petitioners/A2 and A4 would not hinder the investigation in any way. Furthermore, considering the nature of the accusations levelled against the petitioners, the custody of the petitioners is also not required. Considering the fact that the petitioners/A.2 and A.4 were granted bail, this Court is of the view that granting anticipatory bail to the petitioners herein will not affect the investigation in any way. The learned counsel for the petitioner submits that the petitioners are permanent residence of Thonduru Village of Tirupati District, and there is no possibility of their fleeing from the jurisdiction of the Court. \

1 Upon careful review of the available material, as there is no risk of interference with the ongoing investigation by the Petitioners, this Court finds that anticipatory bail can be granted to the petitioners herein under certain conditions:

(i) The petitioners/A.2 and A.4 are directed to surrender before the Station House Officer concerned within two (2) weeks from today, (ii) On such surrender, the petitioners shall be released on bail on their executing a personal bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each to the satisfaction of the arresting Police officials, (iii) The petitioners shall cooperate for investigation and they shall appear before the investigation officer as and when their presence is required. 4 (iv) The petitioners shall pot cause any threat, inducement or promise to the prosecution witnesses. With the above directions the Criminal Petition is allowed. 11. in this Criminal Petition applications pending, if any Miscellaneous shall stand closed. SDI- K.
