The Regional Joint Director, School Education Department, Kakinada i District ...Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue an order, writ or direction, more particularly one in the nature of WRIT OF MANDAMUS declaring the action of respondents more particularly the action of the 3rd and 4th respondents in calling the petitioner to their offices without notice and harassing him in the guise of settlement of a civil dispute already pending before a competent Civil Court as illegal arbitrary and violative of Articles 14 and 21 of the Constitution of India and consequently direct the respondents not to interfere with the petitioners service career or initiate any disciplinary proceedings against him on the basis of private complaints arising out of chit fund transactions, which are civil in nature and if at ail the respondents intend to call the petitioner for any official purpose, they shall issue a proper notice in writing indicating the reasons and afford due opportunity in accordance with law and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the respondents not to interfere with the petitioner’s service or call the petitioner to their offices without issuing proper written notice and without following due process of law pending disposal of the above writ petition in the interest of justice and pass Counsel for the Petitioner: PAMARTHY RATHNAKAR Counsel for the Respondents: GP FOR HOME Counsel for the Respondents:GP FOR EDUCATION The Court made the following order: THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 24410 OF 2025 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer: “…pleased to issue an order, writ or direction, more particularly one in the nature of WRIT OF MANDAMUS declaring the action of respondents more particularly the action of the 3rd and 4th respondents in calling the petitioner to their offices without notice and harassing him in the guise of settlement of a civil dispute already pending before a competent Civil Court as illegal arbitrary and violative of Articles 14 and 21 of the Constitution of India and consequently direct the respondents not to

Heard Sri Pamarthy Rathnakar, learned counsel for the petitioner and Sri V. Farooq, learned Assistant Government Pleader appearing for the Home. 03. Leamed counsel for the petitioner would submit that the respondent police are calling the petitioner to the police station without notice and harassing him to settle the civil dispute which is already pending before the competent Civil Court. 04. The learned Assistant Government Pleader submitted that the Additional Superintendent of Police, East Godavari, Rajamahendravaram, has submitted a report to the District School Education Officer stating that the complaint made try Sri Kalepu Swaminandhan and four other teachers was received through the PGRS program on 07.07.2025, wherein they had approached the Superintendent of Police, East Godavari District. Rajamahendravaram, with allegations against the petitioner. The petitioner was called only for a preliminary enquiry. It is further submitted that, after conducting the enquiry, the Additional Superintendent of Police sent a requisition to the District Educational Officer to initiate departmental action against the petitioner. The police have never harassed the petitioner or interfered in the civil disputes between the parties. 05. Considering the submissions, this Writ Petition is disposed of. However, police are directed not to call the petitioner to the police station, in absence of any crime registered against the petitioner. There shall be no order as to costs
