1. The petitioners preferred the present writ petition under Article 226 of the Constitution of India seeking a direction towards the respondent authorities to pay compensation amount to the petitioners in lieu of the land acquired from them for the purpose of construction of road. For which several representation have been filed by the petitioners is pending consideration.

Learned counsel appearing for the petitioners submits that the respondents have constructed a road over the land of the petitioners who are agriculturists of village Nagdha. Though the land of the petitioners has been used for construction of a road but no compensation has been paid by the respondent authorities to the petitioners. Thereafter, the petitioners have approached the concerned authorities for compensation on various occasions. Further the petitioners have filed several representations dated 21/12/2023, 22/12/2023 and 19/09/2024 (Annexure P/2) which are still pending before the Sub-Divisional Officer, Navagarh, District Bemetara.

Learned counsel appearing for the respondents/State submits that if the applications/representations are still pending before the concerned authority, the same shall be decided, in accordance with the relevant provisions, within the stipulated period.

4. I have heard learned counsel for the parties and perused the documents.

Looking to the grievance of the petitioners that their land has been used for the purpose of construction of a road without making payment of any compensation and without acquiring the said land, it is directed that the SDO/respondent No.3 shall consider and decide the applications/ representations dated 21/12/2023, 22/12/2023 and 19/09/2024 (Annexure P/2) filed by the petitioners and by making verification of the fact whether the land of the petitioners has been used for construction of road or not by passing a detailed order and if the land has been used without making any payment of compensation, the respondent No.3/SDO (PWD), Navagarh, District Bemetara shall take necessary steps for acquisition of the said land immediately in accordance with law, within a period of 30 days from the date of receipt of a copy of this order.
6. With the aforesaid direction, this writ petition is disposed of.
