5. 22.01.2026 CGR,J I.A.No.1 of 2025 (On being mentioned) The present application is filed under the caption 8for being mentioned9, inter alia stating that though this Court by final order dated 12.09.2025,
disposed the appeal, however has not provided permission in favour of the appellant to withdraw the said amount, which necessitated for filing the present application. Heard learned counsel appellant and
learned counsel for the respondents. Having considered the
order dated 12.09.2025, Para No.6 of the Final
Order/Judgment does not factor withdrawal of the amount so directed to be deposited. Therefore, Para-6 of the Final
Order/Judgment stands substituted as under:- <6. Considering the guidelines prescribed by the Hon'ble Apex Court in judgment mentioned supra, the
order of the Tribunal dated
2 18.01.2023 passed in M.V.O.P.No.77 of 2016 is hereby modified, directing the insurer to deposit the compensation amount before the Tribunal. Except for the aforesaid modification, the rest of the
order and amount of compensation determined shall stand intact. Therefore, the appellant is
directed to deposit balance amount of compensation, deducting the amounts, if any, already deposited, within a period of four (04) weeks from the date of receipt of copy of this order. Upon such deposit, the 1st respondent /claimant is permitted to withdraw the said amount.= The Registry is directed to issue the
order after incorporating the above changes. Accordingly, this Interlocutory Application is ordered. ______ CGR, J CVD
