GP FOR REVENUE 3 HBKM,J W.P.No.13619 of 2020 The Court made the following Order: No representation for the petitioner. Heard the learned Assistant Government Pleader for the respondents. 2. This writ petition was filed questioning the action of the respondent No. 4 in making attempts to dispossess the petitioner from his land in an extent of Ac.0.20 cents in Sy.No.192 of Govindapally Village of Bukkaraya Samudram Mandal, Ananthapuram District, for giving house sites to the house less poor under the Navaratnalu Pedalandariki Illu Scheme without following the due process of law. 3. On the other hand, the learned Assistant Government Pleader relying upon the written instructions of the 4th respondent dated 05.08.2020 submits that the land in an extent of Ac.2.00 cents in Sy.No.192 is classified as Village Site Poramboke and the Government is vested with all the rights to utilize the same for the public purpose. The same was proposed for house sites to the houseless poor beneficiaries under the welfare scheme of housing. When the land was inspected, it was found that the petitioner encroached to an extent of Ac.0.15 cents and as such he was asked to vacate the same after harvesting the crop, but there is an interim order of this Court dated 10.08.2020. 4. In view of the above said facts and circumstances, the respondent Nos.2 to 4 are directed to deal with the subject land in an extent of Ac.0.20 cents in Sy.No.192 of Govindapally Village of Bukkaraya Samudram Mandal, 4 HBKM,J W.P.No.13619 of 2020 Ananthapuram District, strictly in accordance with law, if so warranted for any public purpose and if the petitioner is otherwise found to be in possession of the same as contended by the respondents to an extent of Ac.0.15 cents, he shall be dealt with strictly in accordance with law, by hearing all the parties concerned, including the petitioner, upon verification of the records and the subject land, appropriate decision shall be taken on its own merits. The encroachments, if any, in the subject land, shall be removed, following the due procedure. The written instructions of the 4th respondent dated 05.08.2020 shall be made as part of the Court record. 5. Accordingly, this Writ Petition is disposed of. Interim order if any deemed to have been vacated. There shall be no order as to costs.
