The present Special Leave to Appeal has been filed seeking leave to appeal against the judgment and order dated 25.11.2024, passed by the Court of learned Judicial Magistrate/Civil Judge, Kichha, District Udham Singh Nagar in Criminal Complaint Case No. 2070 of 2022, “Rahul Gandhi vs. Zeeshan Malik”, under Section 138 of the Negotiable Instruments Act, 1881, pertaining to Police Station Kichha, District Udham Singh Nagar, whereby the learned Trial Court below acquitted the accused/opposite party no. 2 of the charge levelled against him.
5. Grounds are sufficient to grant leave to appeal. Accordingly, the leave to appeal is allowed.
6. The Trial Court Record has been received and is part of record.
7. The paper book has also been prepared. The Registry is directed to furnish copies of the paper book to learned counsel for the parties, in accordance with the Rules.
8. Objections, if any, be filed by the Respondents.
9. List this case on 08.06.2026 for final hearing.
