The petitioner has challenged the notice N0.6OO/PCB/RO- 2. OGL/2025-142 dated 05.03.2025, which is a show cause notice issued to the petitioner as to why action should not be initiated for operating without obtaining CTE & CTO of the Board, without providing air pollution control equipment to boiler, without providing ETP & discharging untreated effluents into municipal drain and thereby causing odour nuisance and air pollution in the surrounding area. Fifteen days time was granted to submit the reply. It was provided, failing which action would be initiated under Section 33(A) of Water (Prevention & Control of Pollution) Act, 1974 and under Section 31(A) of the Air (Prevention & Control of Pollution) Act, 1981. 3. Learned counsel for the petitioner submits that the i I petitioner is not covered under the industry. Consequently, the \ notice would not be issued. The petitioner has already filed the 2 reply, taking inter alia, the plea that the petitioner is doing small business in the milk dairy in the village and is not covered under the industry. 4. Since the petition is challenging the show cause notice and has already filed the reply to the same, which is said to be pending, we are not inclined to entertain this writ petition, at the stage of show cause notice. 5. The Writ Petition is being disposed of with direction to the respondents 1 to 3 to consider the petitioner’s reply to the show cause notice and take final decision, in the matter in accordance with law. 6.
