CORAM: - HON’BLE MR. JUSTICE AMBUJ NATH
------ For the Petitioner : M/s. Rahul Pandey, Advocate For the State : M/s. Shweta Singh, A.P.P.
----- 02/07.04.2025
The Petitioner has filed this application for quashing of order dated 18.12.2024 and order dated 02.01.2025 in connection with Mandar P.S. Case No. 137 of 2024 passed by learned S.D.J.M., Ranchi, whereby and wherein, the learned S.D.J.M., Ranchi has issued non-bailable warrant of arrest and process under Section 84 of the B.N.S.S. against the petitioner.
2. The Mandar P.S. Case No. 137 of 2024 has been registered under Sections 64, 351(2) of the B.N.S. which is non-bailable in nature. There is no illegality in the order dated 18.12.2024 passed by learned S.D.J.M., Ranchi issuing non-bailable warrant of arrest against the petitioner. From perusal of the order dated 02.01.2025, it appears that process under Section 84 of the B.N.S.S. was issued after the learned court has received the Execution Report that the petitioner was absconding and concealing himself.
3. In view of this fact, I do not find any illegality in the order dated 02.01.2025 passed by learned S.D.J.M., Ranchi issuing process under Section 84 of the B.N.S.S.
4. This application is dismissed.
