1. With the consent of learned counsel for the respective parties, the matter is heard finally.
2. The limited grievance of the petitioner is that the application under Section 173(8) of Cr.P.C. is pending before the learned Judicial Magistrate First Class, Takhatpur, District Bilaspur (C.G.) in Criminal Case No. 507/2022(State of Chhattisgarh Vs. Ganesh
2 Jaiswal and others) in the light of the earlier direction of this court in WPCR No. 727/2022 vide order dated 21.07.2023.

Learned counsel for the petitioner prays this Court to allow the criminal miscellaneous petition and may direct the learned Judicial Magistrate First Class Takhatpur, District Bilaspur (C.G.) in Criminal Case No. 507/2022 to expedite the application under Section 173(8) of Cr.P.C. which is pending in a stipulated period of time in the spirit of the order passed in WPCR No. 727/2022 dated 21.07.2023 in the interest of justice.
4. Considering the limited grievance of the petitioner, it is directed to make all endeavors to conclude the proceedings pending before it preferable within three months from the date of receipt of copy of this order.
