Neutral Citation No. - 2025:AHC:62873 Court No. - 4 Case :- WRIT - A No. - 5337 of 2025 Petitioner :- Sanjay Singh Yadav Respondent :- State of U.P. and Another Counsel for Petitioner :- Kailash Prakash Pandey Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. Heard learned counsel for the parties. By means of present petition, filed under Article 226 of the Constitution, petitioner has prayed for quashing of the transfer order dated 08th March, 2025 whereby he has been transferred from Kanpur to LIU Lucknow. Learned counsel for the petitioner submits that he has dependent ailing aged mother and nobody is there to lookafter her. It is also submitted that upon the request being made by the petitioner a recommendation was made by Deputy Police Commissioner, Commissionerate, Kanpur Nagar dated 5th April, 2025 to the headquarters and yet petitioner has come to be transferred. Learned Standing Counsel submits that transfer order is passed to facilitate better administration and hence interference with one transfer order would adversely affect the other transfer orders also. Having heard learned counsel for the respective parties and having perused the records, I find that the transfer order has been passed on administrative exigency for better administration, and therefore, I do not find any justification to interfere with the general order of transfer. However, it is provided that in the event, petitioner makes representation against transfer order annexing therewith copy of the recommendation previously made in his favour within a period of four weeks before respondent no. 2 from today, the same shall be disposed of by means of reasoned and speaking order within a further period of four weeks taking into consideration recommendation made in favour of the petitioner. With the aforesaid observations and direction, this petition stands disposed of. Order Date :- 24.4.2025 Sanjeev Digitally signed by :- SANJEEV RANJAN High Court of Judicature at Allahabad
