Instant petition has been filed seeking direction that the respondent no.2 may be directed to decide the appeal No. Nil of 2025, Your Daily Basket Vs. District Magistrate/Licensing Authority filed by the petitioner within a stipulated time. Heard learned counsel for the parties and perused the record. Learned counsel for the petitioner would submit that the petitioner’s license was illegally cancelled by the District Magistrate/Licensing Authority, Dehradun under extraneous pressure. The petitioner challenged the order dated 07.02.2025 of the District Magistrate/Licensing Authority, Dehradun before the Excise Commissioner, Uttarakhand at Dehradun on 04.03.2025 under Section 11 of the United Provinces Excise Act, 1910, but the appeal has yet not been numbered and no order has been passed on its stay application. Learned State counsel, under instructions, submits that the appeal has already been registered as No. 346 of 2025. He gives a statement that 07.05.2025 is the date already fixed in the matter and the appeal would be decided within a period of two weeks.
