JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by accused No.1 under Section 483 of BNSS praying to grant bail in Cr.No.359/2025 of Electronic City Police Station registered for the offence punishable under Sections 3, 4 and 5 of Immoral Traffic (Prevention) Act, 1956 and under Sections 143(2) and 143(3) of BNS. 2. Heard learned counsel for the petitioner and learned HCGP for respondent / State. 3. Learned counsel for the petitioner would contend that the petitioner is a woman and she is in judicial custody since 26.09.2025 and as major portion of investigation is over, she is not required for custodial interrogation. In the averments of the complaint, it is - 3 - HC-KAR NC: 2025:KHC:48442 CRL.P No. 14444 of 2025 alleged that the petitioner was getting ladies from other State and was using them for prostitution in her Ayurvedic Wellness Centre, but the report of the IO indicates that two victims who were secured by them are residents of Karnataka State. The petitioner is ready to co-operate with further investigation and abide by any conditions to be imposed by this Court. With this he prayed to allow the petition. 4. Per contra, learned HCGP would contend that the petitioner in the guise of Ayurvedic Wellness Centre was running prostitution. The voluntary statement of the petitioner indicates that she has been involved in crime in the State of Tamil Nadu. The matter is under investigation. With this she prayed to reject the petition. 5. Having heard the learned counsels, the Court has perused FIR, complaint and other materials placed on record. - 4 - HC-KAR NC: 2025:KHC:48442 CRL.P No. 14444 of 2025 6. The allegation against the petitioner is that she was running Arogya Jivana Ayurvedic Wellness Center in which she was getting victim ladies and using them for prostitution. The petitioner is a woman and is in judicial custody since 26.09.2025. The offence alleged against the petitioner is not punishable with either death or imprisonment for life. It appears that major investigation is over. The petitioner has undertaken to co-operate with the police in further investigation, if any, and abide by any conditions to be imposed by this Court. 7. Considering the above aspects, the petitioner has made out case for grant of bail with conditions. In the result, the following: ORDER The petition is allowed. Petitioner is granted bail in Cr.No.359/2025 of Electronic City Police Station, subject to following conditions: - 5 - HC-KAR NC: 2025:KHC:48442 CRL.P No. 14444 of 2025 (i) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only) with one surety for the likesum to the satisfaction of the jurisdictional Court. (ii) The petitioner shall not tamper the prosecution witnesses either directly or indirectly. (iii) The petitioner shall attend the trial Court on all dates of hearing unless exempted and co-operate for speedy disposal of the case. (iv) The petitioner shall co-operate with the further investigation, if any. (v) The petitioner shall not involve in commission of any offence.
