The present application under Section 528 of the BNSS has been filed to quash the charge-sheet dated 23.06.2024, cognizance/summoning order dated 23.10.2024 as well as the entire proceedings of Criminal Case No.2045 of 2024 (State Versus Sonu Thakur @ Mahesh Singh), arising out of Case Crime No.729 of 2023, under Sections 279 and 304-A IPC, P.S. Chhibramau, District Kannauj, pending in the Court of Additional Chief Judicial Magistrate, Chhibramau, Kannauj. After some arguments, learned counsel for the applicant submits that he does not want to press the present application and the same may be dismissed as not pressed. In view of above, the present application u/s 528 of BNSS is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction. Certified copies of the relevant documents be returned to learned counsel for the applicant after retaining a photocopy of the same.
