Since no steps are being taken by the respondents on the complaints filed by the petitioner with regard to alleged misappropriation of funds by the Gram Panchayat Bag Pashog, Tehsil Pachhad, District Sirmaur, Himachal Pradesh, petitioners have approached this Court in the instant proceedings, praying therein to issue direction to the respondents to take appropriate action in accordance with law on the complaints filed by the petitioners. 2. While accepting notice on behalf of the respondents, Mr. B.C. Verma, learned Additional Advocate General invited attention of this Court to the documents placed on record by the petitioner to
- 2 - demonstrate that pursuant to complaint filed by the petitioner relevant information has been already sought from the relevant quarters. He further states that though steps already stand initiated to constitute an inquiry, but if not, same shall be positively taken expitiditously,

Having heard learned counsel for the parties and perused material available on record, this court finds that petitioners herein made complaints to Block Development Officer Pachhad District Sirmaur, with regard to alleged misappropriation of funds by some of the office bearers and officials of afore Gram Panchayat. Though after receipt of the complaints, authority concerned sought for certain information but fact remains that till date complaints have not been taken to their logical end and as such petitioners are compelled to approach this court in the instant proceedings

Consequently, in view of the above, present petition is disposed of with direction to the Deputy Commissioner, Sirmaur at Nahan, to ensure that appropriate action in accordance with law is taken on the complaints filed by the petitioners expeditiously. Needless to say, authority concerned while doing the needful shall afford an opportunity of hearing to the petitioners and other stake holders, especially persons against whom allegations have been leveled. Pending applications also stand disposed of.
