1. This is an ofÏce reference.
2. This Court, vide order dated 02.08.2024, passed in MCRC No. 5083 of 2024, while rejecting the bail to the applicant, namely, Pooja Gupta, had expressed its trust that the trial Court should make an earnest endeavor to conclude the trial expeditiously in accordance with law, preferably within a period of four months from the date of receipt of a certified copy of this order, if there was no legal impediment.
3. The learned Special Judge (NDPS Act) Balrampur-Ramanujganj, District-Balrampur-Ramanujganj, (C.G.) vide his request letter dated
2 09.12.2024 has requested for grant of four months time for concluding the trial.
4. It transpires from perusal of the PUD, that a witness was examined in the case on August 28, 2024. The case was scheduled for prosecution evidence on September 10, 2024, but the trial was disrupted due to the accused escaping from custody at Ambikapur Hospital. After receiving information about the accused's arrest on September 18, 2024, the case was rescheduled for evidence. The statement of one witness was recorded on 04.10.2024, and another on 21.10.2024. However, the witness failed to appear on October 22, 2024. The evidence of one more witness was recorded on November 13, 2024. Unfortunately, no witnesses appeared on December 9, 2024. The statements of the Drug Inspector, Investigator, and other witnesses are yet to be recorded in the case. Considering the witnesses in the case, the trial is likely to take some time for it conclusion. Therefore, he prays for grant of further four months time for concluding the trial.
5. The request appears to be reasonable. The concerned trial Court is
directed to conclude the trial as early as possible, preferably within a further period of four months from today.
6. Accordingly, this CRMP stands disposed off with the aforesaid direction.
7. Registry is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance. Sd/-
