IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI (Special Original Jurisdiction) PRESENT THE HONOURABLE SRI JUSTICE T MALLIKARJUNA RAO CRIMINAL PETITION NO: 4755/2025 Order: This Criminal Petition under Sections 480 and 483 of B.N.S.S., has been filed by the petitioners/A1 & 4 to 6, seeking regular bail in Cr.No.32/2025 of Piduguralla Police Station, Palnadu District. The above said crime was registered against the petitioners/A1 & 4 to 6 and others for the offence punishable u/Secs. 140(2), 126(2), 105, 108r/w3(5)ofBNS. 2. In brief, it is the case of prosecution that the complainant stated that he has been working as Railway Station Master at Piduguralla Railway Station for the past 3 years. Before that, he was engaged in real estate business in Sattenapalli are. During that time, he became acquainted with the deceased/Muppala Anju Babu. About 10 days ago, deceased and A2 came to complainant’s railway quarters in Piduguralla. They informed him that the deceased had borrowed Rs.2,25,000/- from A1 from Sattenapalli and that they were pressuring him to repay the amount. Due to this, they requested to stay at the complainant’s quarters for few days and he agreed for the same. On 03.03.2025, while the complainant was in off duty and staying in Sattenapalli, at about 1.30 p.m., the deceased called him from his mobile number “9959138117 and stated that he had been kidnapped and that a ransom of Rs. 10,00,000/- was being demanded. When the deceased said that he could not arrange the money, he received another call from A2 phone 3. 2 threatening that if the money was not paid, they would force him to consume poison or pesticide. The deceased told the complainant that A1, A2 and their associates were harassing him severely. Later at about 7.00 p.m., deceased called the complainant again saying that he was being pressured and forced to consume poison as he could not arrange the money. Around 9.10 p.m., the complainant received another call from deceased phone, but that time, an auto driver was speaking. The driver informed him that the owner of the phone i.e., the deceased had consumed poison and was lying unconscious with foam coming from his mouth. He also mentioned that some people had forcefully poisoned him. The complainant instructed the auto driver to bring the deceased to Piduguralla. After his arrival, the complainant admitted the deceased in Subba Rao Hospital and informed about the incident to the wife and children of the deceased. On the next day, they shifted the deceased to Ramesh Hospital in Guntur for better treatment. However, in between 2.30 to 3.00 p.m., on 04.03.2025, the deceased passed away. On 05.03.2025, the complainant lodged written report before police. Basing on the said report, the police registered the same as a case in Crime No.32/2025. 4. Heard and perused the record. The learned counsel for the petitioners submits that the petitioners have been in judicial custody since 07.03.2025. The allegations against Petitioner No. 1 are that he demanded repayment of a loan from the deceased, who subsequently committed suicide, and threatened to discharge the debt. A4 to A6 are alleged to have cooperated with A1 in making the demand for money. The petitioners/AI and A4 to A6 have been in judicial custody since 07.03.2025, and most of the investigation is likely to have been completed by this time, making further detention of 5. 3 the petmoners unnecessary. Upon inquiry, the learned Assistant Public Prosecutor confirmed that the petitioners have no prior criminal antecedents. The learned counsel for the petitioners further submits that the petitioners have a permanent abode in Sattenapalli Mandal, Palnadu District, and there is no possibility of their fleeing the jurisdiction of the Court. In view of the facts and circumstances of the case, since the most of the investigation has been completed, this Court is of the opinion that releasing the present petitioners would not hinder the investigation in anyway. The petitioners have been judicial custody since 07.03.2025. Most of the witnesses have been examined by the investigating agency and the release of the petitioners/A1 & 4 to 6 would not cause hampering of investigation, this Court is inclined to grant bail to the petitioners/A1 & 4 to 6, on the following conditions: 6. (i) The petitioners/A1 & 4 to 6 herein shall be released on their executing a personal bond for Rs.25,000/- (Rupees twenty five thousand only) each with two sureties for a like sum each to the satisfaction of the learned Additional Junior Civil Judge (Junior Division), Palnadu District; (ii) On release, the petitioners/A1 & 4 to 6 shall appear before the Station House Officer concerned on every Sunday between 10.00 a.m. and 1.00 pm for a period of two (02) months. (iii) The petitioners/AI & 4 to 6 shall not tamper with the evidence and hamper the investigation and shall cooperate for investigation. 4 7. Accordingly, the Criminal Petition is allowed. Sd/-G.
