Heard the parties.
The petitioner has been made accused in connection with Latehar P.S. Case No. 139 of 2024, corresponding to NDPS Case No.17 of 2024, for the offences registered under Sections 20(b)(ii)(c) and 29 of the N.D.P.S. Act, pending in the Court of learned Sessions Judge, Latehar.
On 02.08.2024 at about 11:00 P.M., Latehar police on the basis of confidential information intercepted one Swift Dezire car bearing registration No. UK-07-BK-0347 and apprehended this petitioner along with co-accused persons. On search, 45 kgs. of cannabis were recovered from the said vehicle.
Learned counsel for the petitioner submitted that the vehicle in question does not belong to the petitioner.
Learned A.P.P. submitted that quantum of seized cannabis comes within the purview of commercial quantity.
Considering the fact that commercial quantity of cannabis was recovered from joint possession of the petitioner and co-accused persons, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail stands rejected.
