CORAM:- HON'BLE MR. JUSTICE JAGMOHAN BANSAL

for the petitioner.
Mr. Suneel Ranga, DAG, Haryana.

JAGMOHAN BANSAL, J. (ORAL)
1.
As common issues are involved in the captioned petitions, with the consent of both sides, the same are hereby disposed of by this common order. For the sake of brevity and convenience, facts are borrowed from CWP-2252-2007.
2.
The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of order dated 05.02.2007 whereby he was ordered to be reverted from the rank of Sub Inspector (SI) to Assistant Sub Inspector (ASI).
3.
On 13.02.2007 while issuing notice of motion, a Division Bench of this Court stayed operation of impugned order. Order dated PRINCE CHAWLA 2025.09.09 09:53 I attest to the accuracy and integrity of this document
CWP-2252-2007 (O&M) and CWP-9654-2006 (O&M)
-2-
13.02.2007 reads as:
“Learned counsel for the petitioner inter alia contends that the petitioner was granted the benefits of reservation to the ranks of ASI as well as Sub Inspector. However, these benefits which were granted on 5.5.2003, have now been withdrawn vide Annexure P-8 on the ground that the benefit of reservation is not admissible to the rank of Sub Inspector.
Learned counsel contends that the post of Sub Inspector is a Class-III post and hence, as per instructions of Haryana Government, the petitioner would be entitled to the benefits already granted to him.
Notice of motion for 12.7.2007.
In the meantime, operation of Annexure P-8 shall remain stayed.”
4.
The petitioner has retired on attaining the age of superannuation. On account of interim orders, she continued to hold rank of SI and was further promoted as Inspector.
5.
In the backdrop, this Court does not find it appropriate to return findings on merit. It would be in the interest of justice and fitness of things if interim order is made absolute. Accordingly, interim order dated 13.02.2007 is hereby made absolute.
6.
Disposed of.
7.
Pending application(s), if any, shall also stand disposed of.
