1. Heard Mr. Sudeep Shrivastava and Mr. Gurpreet Singh, petitioners in person. Also heard Mr. Shashank Thakur, learned Deputy Advocate General, appearing for the State.
2. The present writ petition has been filed by the petitioners with the following prayers:
“It is, therefore, prayed that this Hon’ble Court may, kindly, be pleased to quash the FIR and the investigation pending against the petitioner vide Crime No. 196 of 2021 registered as PS Lakhanpur, District Ambikapur (Sarguja) Chhattisgarh.”

This is the second round of litigation, earlier the petitioners had filed a writ petition bearing WPCR No. 786 of 2021 and the prayer made therein was also for quashing of the FIR registered against the petitioners, which is the subject matter of present petition. WPCR No. 786 of 2021 was disposed off by this Court on 28.06.2023 directing the Investigating OfÏcer concerned to conclude the investigation within a period of four weeks.
4. Learned State counsel submits that the investigation is still pending and has not been concluded.
5. The petitioners, in person, submit that because of the pendency of the criminal case, causing hurdle in their future career and hence, they have come up before this Court again for the aforesaid prayer.

Considering the fact that the present petitioners have earlier approached this Court by means of WPCR No. 786 of 2021 for the same cause of action and the said petition was disposed off directing the Investigating OfÏcer to conclude the investigation within a period of four weeks and submit a Police Report under Section 173(2) of the Cr.P.C. in accordance with law, but the same has not been concluded as has been stated by the learned State counsel, the present petition is dismissed on the ground of maintainability as it is second petition for the same cause of action.
7. However, the Director General of Police, State of Chhattisgarh is
directed to call an explanation from the concerned Investigating OfÏcer as to why the investigation has not been completed inspite of the order passed by this Court on 28.06.2022 in WPCR No. 786 of 2021 and further ensure that investigation is completed and submit a report under Section 173(2) of the Cr.P.C. (now under Section 193(3) of the BNSS) before the competent Court in accordance with law within a period of four weeks. The same shall be submitted by the Director General of Police, State of Chhattisgarh by filing his personal afÏdavit through the Registrar General of this Court, who shall place the same in the Chamber for perusal at the earliest within a period of four weeks from today.
