ORDER :
This writ petition is filed under Article 226 of Constitution of India with the following prayer for : <…declaring the action of the respondents herein in not releasing the admitted amount of Rs. 14,76,60,775/- for the work executed by the petitioner pursuant to the Agreement No.SE/IC/KNL/37/2021- 2022 dated 14.03.2022 as illegal, arbitrary, unreasonable, violative of Articles 14 and 21 of Constitution of India and consequently direct the respondents herein forthwith to release and pay the said amounts payable to the petitioner along with interest @24 % per annum=. 1. The petitioner was entrusted with the work of “Enhancement of Existing Storage Capacity of 14 number of Tanks in Tuggali Mandal, Kurnool District for an estimated amount of Rs.36,39,00,000/- vide an Agreement.No.SE/IC/KNL/37/2021-2022 dated 14.03.2022. He commenced the said work and completed the same in terms of the agreement. After completion of the work, the respondent authorities issued Quality Control Certificate, record the same in Measurements book and prepared the bill for an amount of Rs.14,76,60,755/-. After verification of the details, the bill was generated in the Comprehensive Financial Management System (CFMS) portal, but inspite of the petitioner approaching the respondent authorities, they have not chosen to process the bill for releasing the amounts. 3
Challenging the said action of the respondents, the present writ petition came to be filed. 2. Inspite of the fact that the bill for payment of the amount has already been generate, the respondent authorities failed to process the same. The said action is nothing but illegal and arbitrary. 3. On the other hand learned Assistant Government Pleader for irrigation on oral instructions submits that the bill for the admitted amount of Rs.14,21,17,463/- payable to the petitioner as per the Quality Control Certificate dated 28.06.2022 have generated in CFMS portal, but the amount was not paid due to non-release of budget.
He submits that soon after release of the budget the bill will be processed and payments will be made to the petitioner. 4. In view of the fact and circumstances of the case and in view of the fact that the bill was processed in CFMS portal and the amount will be released as and when budget is released. The respondents are directed to make the release the amount as per Quality Control Certificate and pay the amount to the petitioner as early as possible within the period of eight (8) months from the date of receipt of copy of this order. 5. As far as interest component is concerned, if there is any subsisting clause in the agreement/work order envisaging payment of interest upon any amount which is due and payable, the same is binding upon both the parties. 4
6. Accordingly, this writ petition is closed. There shall be no order as to costs. 7. Consequently, pending miscellaneous petitions, if any, pending shall be stand closed. __________________ JUSTICE V.SUJATHA
