GP FOR SERVICES I The Court made the following: 2 THE HON’BLE SRI JUSTICE NYAPATHY VIJAY W.P.No.33574 of 2025 O R DE R: The Writ Petition is filed aggrieved by the action of the Respondents in not considering the representation of the Petitioner dated 31.05.2025 seeking transfer from a Tribal Area to a Non-Tribal Area. 2. The facts leading to filing of the present Writ Petition are as follows: The Petitioner is working as a Pharmacy Officer at PHC, Bandaluppi, Parvathipuram Manyam District, from 28.03.2022 The Petitioner had submitted an application 31.05.2025 seeking transfer outside of the Tribal Area in the light of the General Transfer Policy issued vide G.O.Ms.No.23 Finance (HR-I-PLG & Policy) Department, dated 15.05.2025 whereunder a preference was given to the employees who have worked for more than two years in tribal areas. As the Application of the Petitioner is not being considered, the present Writ Petition is filed. 3 3. Sri Karthik Shah, learned counsel for the Petitioner submits that apart from the preference provided under the above-mentioned Government Order, the Petitioner has a physically challenged mother, and providing medical facilities to her in tribal areas is very difficult, and therefore, he seeks consideration of his representation/application dated 31.05.2025 for transfer to the Non-Tribal Area. 4. Sri S. Raju, learned Assistant Government Pleader, would submit that the Petitioner gave representation at the time of General Transfer, and if the Petitioner gives a fresh representation/application along with the medical certificates of the mother of the Petitioner, the Respondent Authorities would consider the same and take the necessary decision in that regard. 5. Heard the respective counsel. 6. In the light of the submissions made, the Writ Petition is disposed of with the following directions: i) The Petitioner shall submit a comprehensive representation/application to the Respondent Authorities along 4 with the Medical Certificates of the mother of the Petitioner within a period of two weeks from the date of receipt of a copy of this Order. ii) On receipt of the representation, the Respondents shall take appropriate decision thereon within a further period of eight weeks. iii) There shall be no order as to costs.
