Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that previously petitioner's first bail application was dismissed vide order dated 18.08.2025 before filing of charge-sheet. The recovery of commercial quantity of tramadol and alprazolam was effected from the possession of other co- accused Sanjay. Co-accused Sanjay in his disclosure statement
[2025:RJ-JP:50627] (2 of 3) [CRLMB-14483/2025] has mentioned the name of Amit Kumar, however, police after investigation did not file charge-sheet against Amit Kumar. It was found that Bilal supplied the said tramadol and alprazolam to the co-accused Sanjay, there is no connectivity between co-accused Sanjay and the present accused- petitioner. The petitioner has not supplied any contraband article to the co-accused. Apart from the single transaction which is between co-accused Sanjay and petitioner's mother there is no other substantive evidence available on the record indicating the fact that petitioner has supplied contraband articles to the co-accused Sanjay. It is also contended that though earlier it was stated that whatsapp chats were found between the petitioner and the co-accused Sanjay, however in the charge-sheet no such whatsapp chats or screenshots were submitted. The accused-petitioner is in custody since 03.05.2025 and there is no criminal antecedents against the petitioner. The trial of the case may take considerable time, therefore, the second bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has opposed the bail application and in pursuant to the direction dated 02.12.2025, submitted the factual report. 4. Heard and perused the material available on record. 5. Though in the factual report it has been mentioned that during investigation whatsapp chats were extracted which transpired between petitioner and co-accused Sanjay, however in the charge-sheet submitted before the trial court the police has not submitted any whatsapp chats transpired between the co-

6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Vishnu Kumar S/o Jaswant Singh, in connection with FIR No. 177/2025 registered at Police Station Hindaun, District Karauli shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
