1. Status report filed by the State be kept with the records.
2. We find that two witnesses out of 13 charge-sheet named witnesses have already been examined. The next schedule has been fixed between January 29-31, 2025.
3. We see that 500 Grams of heroin i.e. much beyond commercial quantity was seized from the joint possession of the accused persons including this petitioner. A 9 mm. pistol was also seized from the petitioner. Hence, the charge under the Arms Act.
4. We also note that the trial is progressing and it cannot be said that the trial is stagnant.
5. Considering the involvement of commercial quantity of contraband items and also recovery of firearms from the petitioner, we are not inclined to entertain the petitioner’s prayer for bail, at this stage. 6. The application being CRM (NDPS) 1791 of 2024 is accordingly dismissed.
7. However, considering the period of detention of the petitioner we direct the learned Trial Court to make all efforts to expedite the trial to the fullest extent possible and conclude the same as soon as possible.
