1. By the instant petition, the petitioners seek the following reliefs:
“10.1 That, this Hon'ble Court may kindly be pleased to call for the entire records of petitioner's earlier petition WP(S) No. 4951/2016 (Beni Ram Sahu & Ors. Vs. State of C.G. & Ors.), from the registry of this Hon'ble Court, for its kind perusal. 10.2 That, this Hon'ble Court may kindly be pleased to grant consequential benefit/relief as granted to the petitioners by this Hon'ble High Court vide order dated 19.12.2023, in WP(S) No. 4951/2016. 10.3 That, this Hon'ble Court may kindly be pleased to direct the concerned respondents authorities to furnish the information regarding number of vacant post of Lecturer (Metallurgy) available in the State of Chhattisgarh, and if, there is no vacant post, then further be pleased to direct the concerned respondents to create at least 3 (three) post of Lecturer (Metallurgy) so that the petitioners may be given appointment, if they found place in the merit list.
10.4 That, this Hon'ble Court may kindly be pleased to direct to the Respondent No. 2 to declare the result of the interview held on 10.09.2024 by the CGPSC for the post of Lecturer (Metallurgy), and if the petitioners found place in the merit list issued while appointing other candidates on 28.09.2016, the petitioners may also be appointed on the said post, in compliance of the order dated 19.12.2023 (Annexure P-1) passed by the this. Hon'ble High Court in WP(S) No. 4951/2016. 3 10.5 That, this Hon'ble Court may kindly be pleased to award the proper compensation to the petitioners from the responsible respondents personally, who deprived the petitioners from getting their legal rights, illegally, arbitrarily and malafide manner. 10.6 That, this Hon'ble Court may kindly be pleased to grant any other relief/relief's in favour of the petitioner, which the Hon'ble Court deemed fit & just in the facts and circumstances of the case, including awarding of the costs to the petitioners.”

In light of the submission made by learned counsel appearing for the Public Service Commission and learned counsel appearing for the State that the entire exercise has been done by the respondents authorities and the Public Service Commission has made a communication with the State Government vide a letter dated 12.9.2024 (Annexure R1) and they have proceeded further and found petitioners No.1 and 3 eligible for the post of Lecturer (Metallurgy) and the State Government has further proceeded to create posts for their appointment, as such, in view of the above submission, I do not consider the present to be a case to proceed further while it is expected that the respondents authorities shall pass appropriate orders in respect of petitioners No.1 and 3 in accordance with law within two months from production of this order. 3. With the aforesaid observations and directions, the writ petition is disposed of. Sd/-
