Neutral Citation No. - 2025:AHC:62977 Court No. - 4 Case :- WRIT - A No. - 5307 of 2025 Petitioner :- Cisf No. 014506273 Ex. Cpmstable Manoj Kumar Singh Respondent :- Union Of India And 4 Others Counsel for Petitioner :- Aklank Kumar Jain,Jitendra Kumar Shishodia Counsel for Respondent :- A.S.G.I.,Prem Narayan Rai Hon'ble Ajit Kumar,J. Heard Sri Aklank Kumar Jain, learned counsel for the petitioner and Sri Prem Narayan Rai, learned counsel for the respondents By means of this petition filed under Article 226 of the Constitution, petitioner has prayed for quashing for the order dated 1st November, 2010 passed by the CASO/ Commandant, CISF, ASG, Ahmedabad and the order dated 1st February, 2011 passed by the Deputy Inspector General, CISF, WZ-AP, HQRS Navi Mumbai/ appellate authority as well as the order dated 19th December, 2011 passed by the authority sitting in revision. Sri Prem Narayan Rai, learned counsel for the respondents has raised a preliminary objections as to the maintainability of this petition as this High Court having no territorial jurisdiction in respect of the order passed by the authority sitting in different other States like Maharashtra and Gujarat. Upon a pointed query being made, learned counsel for the petitioner submits that since the order of the appellate authority and revisional authority has been served upon the petitioner while deciding it at Aligarh, therefore, this Court will have the jurisdiction to decide the matter. In my considered view when the principal order is order of punishment of dismissal from service which had been passed by the authority sitting in Ahmedabad while petitioner was posted at Rajkot and, therefore, Gujarat High Court has the territorial jurisdiction in the matter. In view of the above preliminary objection raised by learned counsel for the respondents is upheld. Therefore, I decline to grant
indulgence in the matter. However, liberty rests with the petitioner to approach before the appropriate High Court, if so advised. Petition stands consigned to records with aforesaid liberty.
