GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent No.3 in harassing the petitioners by summoning them to the respondent No. 4 Police Station at the behest of 2 respondent No. 5 and interfering in a civil dispute pending vide O.S. No.222 of 2009 on the file of Additional Judicial First Class Magistrate, Addanki is illegal, arbitrary, unconstitutional and violative of Art 14,21,300A of constitution of India and consequently direct the respondent No.3 not to summon the petitioners to the respondent no. 4 Police Station without any proper notice under the guise of any civil dispute.” 2. Heard learned counsel for the petitioners and the learned Assistant Government Pleader for Home. 3. Learned counsel for the petitioners would submit that the police are interfering in the civil disputes between the petitioners and unofficial respondent. 4. Sri Md.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that a case has been registered against the petitioners in Crime No.8 of 2023 of Martur Police Station, for the offences punishable under Sections 447, 427, 506 and 509 read with 34 IPC and investigation is completed and charge sheet is also filed against them. 5. Recording the said submissions, the Writ Petition is disposed of. However, the police are directed to follow due process of law regarding the criminal case pending against the petitioners. There shall be no order as to costs.
