2.
Learned counsel for the accused-applicants has submitted that the alleged offences are triable by the First Class Magistrate.
[2025:RJ-JP:49053] (2 of 3) [CRLMB-12984/2025] It is further submitted that the applicants have been in judicial custody for approximately two and a half months and one month respectively. 3. Per contra, learned Public Prosecutor has vehemently opposed the instant bail application and has submitted that there are two criminal antecedents registered against the applicant no.1, namely Gaurav Soni, and as many as four criminal antecedents registered against the applicant no.2, namely Kishore Singh. Thence, the antecedents registered against the applicants reflect their past history and involvement in prior cases.
4. Having heard the arguments advanced by learned counsel for the parties and taking note of the fact that the applicants sold the goods without having any valid title thereto; that an agreement had been executed for a consideration amounting to Rs.1 crore, out of which disputed amount approximately to the tune of Rs. 30 lakhs was allegedly received and shared by the applicants amongst themselves, and looking to the overall facts and circumstances of the case and material on record but without commenting on merits/demerits of the case, this court is inclined to allow the instant bail application of the accused-applicants and enlarge them on bail.
5. Accordingly, the bail applications under Section 483 BNSS are allowed and it is ordered that accused-applicants Gaurav Soni S/o Late Vijay Kumar Soni and Kishore Singh S/o Late Sh.
