The instant appeal has been filed challenging the impugned judgment and decree dated 29.01.2011 passed by the court of Additional District Judge, Deoband, Saharanpur in Original Suit No.97 of 2009, whereby the suit of the plaintiff-appellant has been dismissed. 3. It appears that the first appeal was taken up for hearing on 29.10.2021 and on that day also no one was present to press this appeal, which shows that the plaintiff-appellant is not interested in pursuing the appeal further. As such, the instant appeal is dismissed for want of prosecution of both the parties. 4. Consequently, the impugned judgment and decree dated 29.01.2011 passed by the trial court is affirmed.
