ORAL ORDER
This petition by the respondent in Crl.Appeal No.474/2023 is
directed against the impugned order dated 16.10.2023, whereby the application filed by the petitioner under Section 148 (3) of Negotiable Instruments Act, 1881 was kept in abeyance till disposal of the appeal.
2. After arguing the matter for some time, learned counsel for the petitioner submits that the appeal is posted before the First Appellate Court on 17.03.2025 and present petition may be disposed of directing the First Appellate Court to dispose of the appeal in accordance with law within a stipulated time frame.
3. Having regard to the fact that the impugned proceedings is of the year 2023, I deem it fit and proper to dispose of the petition by directing the First Appellate Court to dispose of the appeal within a stipulated time frame.
4. In the result, I pass the following:

ORDER i. The petition is disposed of. ii. The First Appellate Court is directed to dispose of the appeal in Crl.A.No.474/2023 on the file of LIX Additional City Civil and Sessions Judge, Bengaluru within a period of 45 days from 17.03.2025. iii. It is made clear that all rival contentions on all aspects of the matter are kept open and no opinion is expressed on the merits/demerits of the same.
