Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the Official Respondents more particularly the 3rd and 4th respondent in advising the petitioners to allow the public to use the petitioners private land though there is a government pathway to reach the lands in Sy.No.472/3 situated in Kondaparava revenue village and Sy.No.181 situated in Digavalli revenue village is illegal, arbitrary and violative of Article 14, 21 and 300A of Constitution of India, consequently direct the 3rd and 4th respondent not to interfere with the possession and enjoyment of petitioners Land in RS No. 179 ,180 , 186 and 176-1 in an extent of Ac. 1.04 cents situated at Digavalli revenue village Nuzuvidu Mandal Eluru district IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the 3rd and 4th respondent not to interfere with the possession and enjoyment of petitioners Land in RS No. 179 ,180 , 186 and 176-1 in an extent of Ac.1.04 cents situated at Digavalli revenue village, Nuzuvidu Mandal ,Eluru district pending disposal of the above writ petition Counsel for the Petitioner(S):

ORDER:
1. The writ petition is filed challenging the action of the respondents, particularly Respondents 3 and 4, who allegedly advised the petitioners to permit the public to use their private land, despite the existence of a government pathway to reach the land in Survey No.472/3 of Kondaparava revenue Village and Sy.No.181 of Digavalli revenue village as illegal and arbitrary.
2. Based on the submissions made and the material on record, this Court, by its Order dt.26.09.2025, directed the respondents not to interfere with the possession of the petitioners over the subject land. The said interim
order was extended from time to time.
3. Today, the learned Government Pleader appearing on behalf of the official respondents has placed on record the written instructions furnished by the 4th respondent, dt.03.10.2025. As per the said written instructions, the respondents have denied the allegations made in the writ petition and stated that they never directed the petitioners to permit the public to use their private lands.
4. Considering the submissions made and the instructions furnished by the respondents, the writ petition is closed. However, the respondents are
directed not to interfere with the possession of the petitioners or allow

the public to use the petitioners’ private land without following due process of law.
