Considering the submissions made by the counsel for the appellant, we permit the appellant to withdraw the application under Order 40 Rule 1 CPC which was filed before the court below. In that view of the matter, the order dated 20.11.2019 passed by the court below on application under Order 40 Rule 1 CPC is set aside.
