“(i) That, this Hon'ble Court may kindly be pleased to direct the respondent to provide termination
order so that he may challenge the same in the interest of Justice. (ii) That direction may be kindly be issued that in absence of termination order petitioner may be treated in service with consequential benefits. (ii) Any other relief which may be suitable in the facts and circumstances of the case, may also be granted.”

Learned counsel for the petitioner submitted that vide request letter dated 27-09-2023 the petitioner had requested respondent No.3 to provide order of punishment of termination in departmental enquiry as the same has not been supplied or to pass order for reinstatement of petitioner as over staying of leave after sanctioned casual leave from 26-08-2011 to 05-09-2011 but the same has not been supplied nor order for reinstatement in service of the petitioner has been issued. The petitioner has also enclosed Letter dated 21-02-2022 of Deputy Inspector General of Police in which representation dated 01-12-2022 & reminder dated 17-01-2023 has been replied that petitioner's request for supply of punishment order of termination dated 22-05- 2012 for the preparation of appeal and revision petition which has not been provided and in para 2 it has been mentioned that finial order number (361) dated 22-05-2022 was issued in Hindi language by the enquiry officer. In para 3, it has been mentioned that original copy of final order was handed over to you by detailing a suitable representative at your native place under proper acknowledgment

Name of representative has not been mentioned in para 3 of letter dated 21-02-2022 petitioner has not appointed any representative when petitioner was in the village why punishment order has not been supplied to me has also not been mentioned. Further, on 26-11-2022 petitioner has also applied of supply of Xerox Copy but the same has not been supplied. After recovery from illness as the petitioner was suffering from typhoid fever, the petitioner joined his duties on 02-05-2012 but respondents have not paid pay or subsistence allowance to the petitioner. He also submits that Enquiry Report dated 09-04-2012 by the Enquiry Officer CISF Unit BSP Bhilai which proves that Departmental Enquiry was only for minor misconduct of over staying leave, and the petitioner has been terminated after said enquiry proceedings, however he has yet not received order of termination, as such he was unable to file an appeal or other petition. As such, he is seeking limited relief, directing the respondent authorities to give order of punishment to him.

Learned counsel for the respondent submits that though according to his instruction the termination order has already been sent to him, however, he will verify the same from the records and if the termination order has not been received by the petitioner, he will take appropriate step, so that the petitioner may receive the termination order within a short span of time.
5. Be that it may be, the respondents are directed to give copy of the
4 termination order to the petitioner within a period of three weeks on the address given in this petition or in alternate respondent No.3/ Commandant, CISF, BSP Unit Bhilai, District Durg (C.G.) is
directed to sent a copy of his termination order to the petitioner in his given address and the petitioner is also at liberty to get a copy of the same from the respondent No.3 personally after giving receipt of the same while producing this order. The respondent authorities may also give particulars by which they have sent the copy of same on an earlier occasion and also send a copy of the same to the Registry of this Court for compliance of this order.
6. With the aforesaid observation and directions, the instant petition is disposed of.
