Sri Ankit Srivastava, learned counsel for the applicant, as per instructions, submits that though the application has been preferred to quash the impugned charge sheet dated 11.01.2023(Annexure No.5) submitted against the applicant in Case Crime No.37/2022, Under Section 202 IPC, PS-Badashahi Naka, District: Kanpur Nagar, cognizance / summoning order dated 16.01.2024passed by Special Judge, SC/ST ACT, Kanpur Nagar and the N.B.W./82 Cr.P.C., order dated 05.12.2024(Annexure No.6) passed by learned Special Judge, SC/ST ACT, Kanpur Nagar well as entire criminal proceedings initiated in pursuance thereof against the applicant in Sessions Trial No.72/2023 (State Vs. Deepak and others) Case Crime No.37/2022, under section 202 IPC, PS-Badshahi Naka, District: Kanpur Nagar, pending in the court of learned Special Judge, SC/ST ACT, Kanpur Nagar, however, he confines his relief for enlargement on bail in view of the law laid down in Satender Kumar Antil Vs. Central Bureau of Investigation and another; decided on 07.10.2021 in S.L.P. No.5191 of 2021. 2. Learned A.G.A. has no objection to the same. 3. Considering the submissions raised at the Bar, the application stands disposed of granting liberty to the applicant to prefer appropriate application for enlargement on bail which this this Court has no reason to disbelieve that the same shall be decided with most expedition strictly in terms of the judgment passed in Satender Kumar Antil (supra).
