(ORAL) The petition has been filed inter alia seeking a writ of mandamus directing the respondents to count petitioner’s suspension period as regular service and release back wages, pensionary benefits, pay fixation arrears, with interest as per Rule 79 of the Haryana Civil Services (Pension) Rules, 2016. 2. Learned State counsel has received instructions from the Department vide memo dated 07.07.2025, a copy whereof is retained on the case file as Annexure ‘A’. It is to the effect that pursuant to direction issued SEEMA 2025.07.16 15:26 I attest to the accuracy and integrity of this document CWP-10645-2025 -2- by this Court vide order dated 04.07.2019, passed in CWP No.11719 of 2019, third respondent/Director Secondary Education passed a speaking order, dated 20.07.2019, rejecting the petitioner’s claim for fixation of his pay according to recommendations of the Seventh Pay Commission with effect from 01.01.2016, and for payment of subsistence allowance from 01.02.2016 to 31.10.2017. 3. Since the order has not been challenged by the petitioner, and the petition makes no mention of it, learned counsel for the petitioner seeks permission to withdraw the petition with liberty to challenge the afore-mentioned order in accordance with law, if so advised. 4. Permitted to do so. 5. Petition is dismissed as withdrawn with the liberty sought.
