ORDER:-
This Writ Petition is filed by the petitioner, under Article 226 of the Constitution of India seeking Mandamus, for the following relief:
“…to issue a Writ Order or direction particularly, one in the nature of writ of Mandamus declaring the action of the respondent No.3-5 in kept pending the petitioners representations dated 10/10/2024 to initiate action against the illegal construction of multi Storied Building by encroaching the eastern side Public Park area made by the respondent no.8 by deviating from the approved layout issued by the 4th respondent, situated at the approved layout of VUDA in Plot No.3, 4, 5 of extent 50x80 bit of vacant site 1333 Sq Yards at Santiniketan Co-Cooperative House Building Society is as illegal, arbitrary and in violation of the petitioner’s fundamental rights guaranteed under Articles 14, 19, 21 and 300A of the Constitution of India consequently direct the respondent authorities to stop the further construction building duly considering the representation of the petitioner dated 10/10/2024...”

The case of the petitioner is that the petitioner has already sent legal notice on respondent No.3 on 10.10.2024 requesting to initiate action as against the unofficial respondents herein for illegal occupation/encroachment of the eastern side park place. As no action has been initiated so far, the present writ petition is filed. 3. Today when the matter came up for hearing, the learned Standing Counsel for Municipal Corporation, has stated that they would initiate action in pursuance of the legal notice dated 10.10.2024. 4. In view of the same, instead of keeping the writ petition pending, this Court feels it appropriate to direct the 3rd respondent to conduct enquiry in pursuance of the legal notice addressed by the petitioner on 10.10.2024 and
initiate appropriate action in accordance with law, within a period of four (04) weeks. 5. With the above direction, the Writ Petition is disposed of. No order as to costs.
