THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION No.18602 OF 2020 ORDER:- 1. The writ petition is filed under Article 226 of the Constitution of India to declare the action of Respondent Nos.3 to 10 in not taking action against the 11th respondent and their men in doing unauthorized pisciculture in Settipalli Tank situated in Settipalli Gram Panchayat, Chittoor District. 2. None appears for the petitioner. 3. During hearing, learned Standing Counsel furnished written instructions issued by the Panchayat Secretary, New Mangalam Gram Panchayat, Tirupati dated –Nil-, stating that, Settipalli Tank falls within Settipalli Gram Panchayat. Vide G.O.Ms.No.14 dated 21.03.2023, Settipalli Gram Panchayat consisting of five villages i.e. 1. Settipalli, 2. SettipalliHarijawada, 3. Upparapalem 4. C.S.R. Quarters 5. Vinayakanagar, were merged into Tirupati Municipal Corporation, thereby, Settipalli Tank also falls under the jurisdiction of Tirupati Municipal Corporation. Further, it is stated that the Settipalli Tank does 2 NV,J W.P.No.18602 of 2020 not come under the jurisdiction of New Mangalam Gram Panchayat, as such, the relief claimed by the writ petitioner cannot be implemented by the Gram Panchayat, thereby the matter has become infructuous. 4. Since, the issue involved in the present writ petition relates to unauthorized pisciculture in Settipalli Tank, which recently came to be merged into Tirupati Municipal Corporation vide G.O.Ms.No.14 dated 21.03.2023, and also in view of the fact that, Tirupati Municipal Corporation is not impleaded as party respondent for adjudication of the dispute between the parties in this writ petition, no further orders are needed to be passed in this writ petition. 5. Accordingly, writ petition is dismissed as infructuous. 6.
