The petitioners through instant petition under Articles 226/227 of the Constitution of India are seeking direction to the respondents to count their daily wages/work charge services for the purpose of pensionary benefits/retiral benefits which was rendered prior to regularization.

Mr. Sandeep Thakan, Advocate submits that claim of the petitioners is squarely covered by order dated 18.10.2024 (Annexure P-8) passed by this Court in CWP No.27914 of 2024, Chander Bhan and others v. Managing Director, HVPNL and others read with order dated 07.02.2025 (Annexure P-9) passed by Executive Engineer, Transmission System Division, HVPNL, Jind.

Mr. Prince Singh, Advocate, who on advance notice is present in Court on behalf of the respondents, expressed his inability to controvert applicability of aforesaid orders to the facts of present case.

In the wake of statement of both sides, the present petition stands disposed of in terms of order dated 18.10.2024 passed by this Court in Chander Bhan (supra).

It is made clear that that petitioners shall not be entitled to interest on delayed payments if arrears are paid within two months from today failing which respondent shall be liable to pay interest @ 9% per annum.
