Brief facts of the cases are as follows: a) The petitioners herein were appointed as temporary dealers for their respective Fair Price Shops by the Revenue Divisional Officer on 14.11.2013 and have been running the said shops in accordance with the instructions issued by the competent authorities, pursuant to the cancellation of the authorizations granted in favour of the unofficial respondents by the Revenue Divisional Officer on the same date . b) Aggrieved by the said cancellation orders, the unofficial respondents preferred appeals before the Joint Collector, which were dismissed and further confirmed in revisions preferred before the District Collector, Kakinada, 13 VS,J W.P.Nos.8248, 8250, 8251, 8253 & 8254 of 2024 confirming the orders passed by the Revenue Divisional Officer and the Joint Collector. c) Subsequently, the unofficial respondents preferred second revisions before the 1st respondent. During the pendency of the said revisions, the petitioners herein sought to file applications for impleadment. However, the said applications were not entertained by the Section Officer. Consequently, the petitioners herein sent their implead applications by registered post, which were admittedly received by the office of the 1st respondent. Despite the pendency of the implead petitions, the 1st respondent allowed the second revisions without issuing any notice to the petitioners herein who are in fact the affected parties and restored the authorizations in favour of the unofficial respondents. d) Aggrieved by the said restoration orders, the petitioners herein filed W.P.Nos. 18478, 18480, 18484, 18504 and 18582 of 2023 before this Court. This Court, vide common order dated 13.09.2023, allowed the said writ petitions and remitted the matter back to the 2nd Revisionary Authority i.e., 1st respondent, with specific directions, which reads as follows: 12. In the above premise, the Writ Petitions are allowed. The Impugned Orders are set aside. The matters are remitted back to the 2nd Revisionary Authority, with a direction to entertain the Applications filed by the present Writ Petitioners in the capacity of Temporary Dealers and also to pass a reasoned order giving detailed reasons after hearing all parties, including the Temporary Dealers. This exercise shall be completed by the 2nd Revisionary Authority namely the Ex. Officio Secretary to Government of Andhra Pradesh, within six weeks from 14 VS,J W.P.Nos.8248, 8250, 8251, 8253 & 8254 of 2024 today. The Writ Petitioners shall place a copy of this Order on the file of the Ex. Officio Secretary to Government of Andhra Pradesh within one week from the date of uploading of this Order. It is clarified that this Court has not expressed anything on merit as regards the entitlement of either of the Permanent Dealer or the Temporary Dealer. The 2nd Revisionary Authority shall consider and dispose of the case of the Permanent Dealers on its own merit in accordance with law by adhering to the above directions. It is also clarified that the 2nd Revisionary Authority, while entertaining the Applications for Impleadment, shall also give Notice of hearing to the Temporary Dealers during every hearing. No order as to costs. e) In pursuance of the orders passed by this Court on 13.09.2023 in W.P.No.18478 of 2023 and batch, the 1st respondent issued a notice on 27.02.2024 calling for hearing of both the parties on 01.03.2024. But however the case of the petitioners is that the said notice was served on the petitioners on 01.03.2024 itself. As such, they have submitted representation on 02.03.2024 requesting the 1st respondent to afford them an opportunity of hearing stating that they received the notice on 01.03.2024 and therefore they could not appear for the enquiry. In spite of the same, the 1st respondent reserved the matter on 01.03.2024 itself and passed the orders on 12.03.2024 restoring the authorization of the subject fair price shops in favour of the unofficial respondents. Thereafter, the 4th respondent implemented the said order and vide proceedings dated 14.03.2024, restored the authorization in favour of the unofficial respondents, duly withdrawing the temporary appointment orders issued in favour of the petitioners. Challenging the said orders, the petitioners filed the present writ petitions. 15 VS,J W.P.Nos.8248, 8250, 8251, 8253 & 8254 of 2024 3. Heard learned counsel for the petitioners and the learned Assistant Government Pleader for Civil Supplies. 4. The learned Assistant Government Pleader for Civil Supplies has admitted that the petitioners herein submitted a representation dated 02.03.2024, bringing to the notice of the 1st respondent that they could not attend the enquiry conducted on 01.03.2024. He, however, submits that considering the fact that unofficial respondents had crossed the age limit for seeking any other employment, their request was allowed on humanitarian grounds and they were permitted to continue as fair price shop dealers, vide impugned proceedings dated 12.03.2024. 5. On a perusal of the impugned proceedings dated 12.03.2024, it can be observed that in view of the categorical directions issued by this Court W.P.No.18478 of 2023 and batch, it is for the 1st respondent to hear the petitioners, who are the temporary dealers and also affected parties and thereafter should have passed a detailed reasoned order, as they were appointed in the year 2013 itself. On a perusal of the record, it appears that no such enquiry has been conducted by the 1st respondent. When the petitioners submitted a representation on 02.03.2024 bringing to the notice of the 1st respondent that they could not attend for the enquiry being conducted on 01.03.2024, as they received the notice on the same day, it is for the respondents to give a fair opportunity to the petitioners in pursuance to the orders passed by this Court in W.P.No.18478 of 2023 and batch. However, the 1st respondent passed the impugned proceedings by simply stating that 16 VS,J W.P.Nos.8248, 8250, 8251, 8253 & 8254 of 2024 the petitioners have failed to attend the enquiry on 01.03.2024 and considering the fact that the unofficial respondents have crossed their age limit for seeking any other employment, their request is considered on humanitarian grounds and accordingly they are allowed to continue as fair price shop dealers. Such an order cannot be called a reasoned order as it admittedly was passed without hearing the petitioners pursuant to the orders passed by this Court in W.P.Nos.18478 of 2023 and batch. Hence, the impugned orders dated 23.03.2024 are liable to be set aside. 6. Accordingly, these Writ Petitions are allowed setting aside the impugned orders dated 12.03.2024 and 14.03.2024. The matters are once again remanded back to the 1st respondent for passing appropriate orders, in accordance with the observations made by this Court vide common order dated 13.09.2023 in W.P.No.18478 of 2023 and batch. The said process shall be completed within eight (08) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
