ORAL ORDER
In this petition, petitioners have sought for the following reliefs:-
"Quash the F.I.R. in Crime No.25/2025 for the alleged offences punishable under Sectikon 115(2), 126(2), 189(2), 191(2), 324(4), 329(3), 351(2), 351(3) and 352 of the Bharatiya Nyaya Sanhita, 2023 registered by the Commercial Street Police Station, Bengaluru pending on the file of the X ACMM, Mayohall at Bengaluru and grant such other relief/s as this Hon'ble Court deems fit to grant in the facts and circumstances of the case, in the interest of justice and equity."

Learned counsel for the petitioner–accused Nos.1 and 2 and learned counsel for the respondent No.2-complainant have filed a Joint Affidavit duly signed by the petitioners and respondent No.2 and the same is taken on record. 3. Petitioner–accused Nos.1 and 2 and their counsel and respondent No.2-complainant and his counsel are physically present before the Court and they admit the contents of the Joint Affidavit, which reads as under:-
“JOINT AFFIDAVIT I Sri. Pramod Kumar C.K. S/o C. Kosalram, aged about 47 years, R/at: No.68, Jewellery Street, Near Taj Hotel, Shivajinagar, Bengaluru North-560 001, the petitioner No.1 (Accused No.1) in the above petition, now at Bengaluru do hereby solemnly affirm and state on oath as follows:- I, Naveen Kumar N. S/o Narasimha, aged about 34 years, R/at: No.56, Sajapura road, Chikkayanakanahalli, Near Anjane Temple, Bengaluru -560 035, the petitioner No.2 (Accused No.2) in the above petition, now at Benglauru do hereby solemnly affirm and state on oath as follows:- I, P.R. Kopathi, S/o. Pandurangan Naidu, aged about 57 years, R/at: No.714, Jewellery Street, Commercial Street, Shivajinagar, Bengaluru-560 001., the complainant/respondent No.2 in the above petition, now at Bengaluru do hereby solemnly affirm and state on oath as follows:-

1. We state that, complaint came to be registered in Cr.No.25/2025 in Commercial Street Police Station for the offence U/S 115(2), 126(2), 189(2), 191(2), 324(4), 329(3), 351(2), 351(3), 352 of BNS which is pending on the file of Hon'ble The ACMM, Mayo Hall, Bengaluru. 2. We state that, we are friends and known to each other for years and on the account of some misunderstanding a complaint came to be registered against the petitioners herein. 3. We state that, on the advise of elders, well wishers, we do not want to prosecute the criminal case as we have amicably settled the dispute out of the court and in order to maintain cordial relationship and harmony, we do not want to prosecute, the criminal case in Cr.No.25/2025. WHEREFORE, we most humbly prayed that this Hon'ble Court may kindly be permitted the parties to compound the offences punishable under sections 115(2), 126(2), 189(2), 191(2), 324(4), 329(3), 351(2), 351(3) and 352 of BNS in Crime No.25/2025 pending on the file of Hon'ble X ACMM, Mayo hall, Bengaluru by Commercial Street Police, and consequently quash the entire criminal FIR in the interest of Justice and equity."

In view of the aforesaid settlement entered into between the petitioners and respondent No.2, I pass the following:
ORDER (1) Criminal Petition is disposed of in terms of Joint Affidavit dated 24.02.2025;

(2) The proceedings pursuant to registration of F.I.R. in Crime No.25/2025 by the respondent No.1– Commercial Street Police Station, Bengaluru for the offences punishable under Sections 115(2), 126(2), 189(2), 191(2), 324(4), 329(3), 351(2), 351(3) and 352 of the Bharatiya Nyaya Sanhita, 2023 pending on the file of the X Additional Chief Metropolitan Magistrate, Mayo Hall, Bengaluru against petitioner-accused Nos.1 and 2 are hereby quashed.
