The petitioner- Md. Asfaque @ Asfaque Ansari is in custody since 22.08.2022 in connection with S.T. No.143 of 2023 arising out of Budhai P.S. Case No. 18 of 2020 for the offence registered under Sections 147, 148, 149, 341, 323, 324, 325, 427, 452, 307, 120B and 302 of the IPC pending in the Court of learned learned Additional Sessions Judge-I, Madhupur. Earlier bail application of this petitioner was rejected vide order dated 01.03.2024 and the same has now been renewed on the ground that out of 28 charge sheeted witnesses, only 11 have been examined till date. Learned A.P.P. opposed the prayer for bail. Considering the stage of trial, I am not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner, is hereby, rejected.
