ORDER: The present Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:
“...to issue a writ or wirts or order or orders one more particularly in the nature of Writ of Mandamus to declare the action of the 4*^ respondent in not receiving, registering and releasing the sale deed dated 25.06.2025 presented by the petitioners as illegal, arbitrary and unconstitutional and consequently direct the 4**^ respondent to forthwith receive, register and release the sale deed dated 25.06.2025 presented by the petitioners and to pass ...” The grievance of the petitioner is that the 4*'^ respondent is not receiving and registering sale deed dated 25.06.2025 of the
2. petitioner. Aggrieved by the same, the present Writ Petition is filed seeking a direction to receive and process the sale deed dated 25.06.2025, forregistration
3. Under Section 71 of the Registration Act, 1908, every Sub- Registrar shall record reasons of refusal and record his reasons for such order in his Book No.2, and endorse the words ‘registration refused’ on the document.
4. As per Section 71 of the Registration Act, 1908, the respondent is obligated to receive or refuse the document by a reasoned order and he cannot keep it pending without passing any
order.
5. Therefore, the present Writ Petition is disposed of directing the 4 respondent to receive the document, register and release the document if it is in accordance with law and if it is not fit for registration, the 4**^ respondent is directed to record accordance with law and communicate the same to the petitioner herein.
