Neutral Citation No. - 2025:AHC:59824 Court No. - 33 Case :- WRIT - C No. - 12049 of 2025 Petitioner :- Arvind Kumar Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Vishnu Murti Tripathi Counsel for Respondent :- C.S.C. Hon'ble Prakash Padia,J.
1. The petitioner has preferred the present petition inter alia with the prayer to direct the Respondent no. 2/District Magistrate, Muzaffarnagar to pass appropriate orders on the application submitted by the petitioner for the transfer of fire arm license in his favour.
2. It is argued that the father of the petitioner is having a fire arm license and due to his old age and no objection certificate in the shake of notary affidavit has been given by him to transfer the same in favour of the petitioner. It is further argued that in this regard an application was submitted by the petitioner before the District Magistrate concerned and though a considerable time has already been lapsed but till date no final decision has been taken in the matter. Hence the present petition.
3. After going through the records, certain deficiencies were found by the Court in the notary affidavit submitted by the father of the petitioner. In this view of the matter the Court sought assistance from the learned Senior Counsel Mr. V.K.Singh, who is present in the Court at the time of argument, is obliged to assist the Court and after going through the notary affidavit filed by the father of the petitioner, it was found by him that there are certain defects in the aforesaid affidavit, hence it is argued that the petitioner is permitted to dismiss the
present petition as withdrawn with liberty to move a fresh application for transfer of the fire arm license in his favour alongwith fresh affidavit of the father of the petitioner.
4. This prayer has not been opposed by the learned Standing Counsel appearing on behalf of State-respondents.
5. Accordingly, the present writ petition is dismissed as withdrawn with liberty as prayed.
