No one has appeared on behalf of the petitioners except learned AGA for the State. As per the instructions received by learned AGA, the petitioner no. 2, Pradeep @ Hridesh is an accused and has been charge sheeted in case crime no. 170/2023, u/s 363, 366, 376(3) IPC and section 3/4 (2) POCSO Act. The corpus is happily residing with her parents and has not been illegally detained. In view of the above, this Court finds that the petitioner no. 1, Karishma has not been illegally detained, the present habeas corpus petition does not lie and is liable to be dismissed.
