JUSTICE SANDEEP KUMAR ORAL ORDER 2 25-07-2025 Heard learned counsel for the petitioner and learned APP for the State. 2. The petitioner seeks bail in connection with S.Tr. No. 409 of 2024 arising out of Rauta P.S. Case No. 132 of 2023 registered for the offence under Sections 341, 323, 504, 506/34 of the Indian Penal Code, thereafter, Sections 302/120(B) of I.P.C. was added. 3. As per the prosecution case, the petitioner and other co-accused persons holding lathi, danda and dabia came to the courtyard of the informant and have assaulted the informant. When his brother came to rescue, they also assaulted him badly due to which he become unconscious and died. It is also alleged that the accused persons also took cash, gold and silver with them from the almirah. Patna High Court CR. MISC. No.34374 of 2025(2) dt.25-07-2025 2/2 4. It has been submitted by the learned counsel for the petitioner that there is general and omnibus allegation against the petitioner and the petitioner is in custody since 20.08.2023. 5. Considering the aforesaid facts, this application is allowed. 6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 4th Additional Sessions Judge, Purnea/concerned Court below in connection with Rauta P.S. Case No. 132 of 2023, subject to condition that:- (i) The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and non-cooperation in the trial shall result in cancellation of the bail bonds of the petitioner. 7.
