ORDER:
1. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the State.
2. The petitioner seeks modification of the order, dated 24.04.2025, in CrI.M.P. No.378 of 2025 in C.C. No.513 of 2014 on the file of the Court of the Judicial Magistrate of First Class, Mydukur, Y.S.R. Kadapa District, whereby the learned Magistrate, while allowing the petition filed by the petitioner seeking renewal of their passport, imposed a condition that the petitioner shall not leave India without prior permission from the Court of the learned Magistrate as well as the passport authorities. It is further
directed that the passport authorities to issue a renewed passport under category EA (P-2).

The learned counsel for the petitioner submits that the passport can legally be renewed for the full term of ten (10) years, and restricting the renewal to a mere one (1) year would be arbitrary and prejudicial to the petitioner, causing unwarranted hardship and limitations. It is further submitted that the petitioner’s passport was expired on 28.02.2025, and requires to renew the same.
4. In the matter of Vangaia Kasturi Rangacharyulu v. CBI^ the Hon’ble Supreme Court directed the passport authority to renew the passport Crl.A.No.l342of 2017
a ; and also held that passport authority cannot refuse renewal of passport on ground of the pendency of criminal case. In the matter of Venkata Siva Kumar Yadhanapudi v. The Union of India and another^ and in the matter of Arihant Prakash Katariya v. The State of Telangana and others^ the Telangana High Court considered the similar issue and referred to various judgments passed by the Hon’ble Supreme Court, directed the passport authority to renew the passport of the petitioner. Considering the submissions and the facts placed on record, there shall be a direction to the passport authorities to renew the passport for a period of ten (10) years as done in all the cases, subject to the application of the petitioner being in order. Further, the petitioner shall comply with the directions of the learned Magistrate for undertaking any travel.
