Hon'ble Vipin Chandra Dixit,J. Petitioner's grievance in the present writ petition is with regard to a pond, which had an embankment around it, which got damaged. On the previous occasion, directions were issued by this Court requiring the State Authorities to complete the construction of embankment. An affidavit of compliance has been filed by the District Magistrate, Muzaffarnagar, wherein various photographs are annexed, in order to show that beatification of pond and construction of embankment is undertaken. Learned counsel for the petitioner, however, has placed certain photographs before the Court in order to state that the embankment got damaged within two days of its completion and the same situation exists on the spot, as it existed earlier. The photographs placed before the Court are taken on record. Considering the nature of grievance raised, we are of the view that the second respondent be directed to get the grievance of petitioner verified by deputing a responsible officer to visit the pond, within two weeks from the date of presentation of a certified copy of this order before him. In the event it is found that the embankment is damaged, the second respondent shall ensure that corrective measures are taken so that the problem of residents is resolved on a permanent basis, at the earliest possible.
