Neutral Citation No. - 2025:AHC:60912 Court No. - 4 Case :- WRIT - A No. - 5148 of 2025 Petitioner :- Naveen Mehrotra Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Kamala Kant,Vidya Dhar Yadav Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. Heard learned counsel for the parties. By means of present petition filed under Article 226 of the Constitution, petitioner has questioned the transfer order dated 25th March, 2025 whereby he has been Moradabad to Mirzapur. It is contended on behalf of the petitioner that on a sheer third party complaint, petitioner has been penalized with transfer order for some directions issued by the State Government. It is submitted that his transfer is neither in public interest, nor in administrative exigency, no such reason has been assigned in the order of transfer. Learned Standing Counsel on contrary submits that since State Government had issued directives, therefore, petitioner has been transferred in district Moradabad, now he cannot complaint against transfer as he is working on transferrable post. Having heard learned counsel for the respective parties and having perused the records, I find that the order is of-course silent regarding reason of public interest or public exigency, however, it appears that on some dictates issued by the State Government, transfer has been given effect to. In the given facts and circumstances, therefore, it is hereby provided that in the event petitioner prefers representation against transfer order dated 25th March, 2025 before respondent no. 1, it shall be looked into and considered and shall be disposed of by means of a reasoned and speaking order within a further period of six weeks. It is further provided that since petitioner complaints that since transfer has been given effect to on the basis of complaint then an opportunity of hearing shall be afforded to him, may be giving him notice to reply the same before passing final order. It is also provided that and State Government finds that directions for transfer were for complaint only, until such decision is taken, the order of transfer dated 25th March, 2025 would not be given effect to.
