JUSTICE SANDEEP KUMAR ORAL ORDER 2 18-06-2025 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. 2. The petitioner seeks bail in connection with Kateya P.S. Case No. 482 of 2024 registered for the offence under Sections 64(1) of the BNS; under Section 8, 12 of the POCSO Act and under Section 67 of the I.T. Act. 3. As per the prosecution case, the petitioner is accused of having sexual relationship with the victim on the pretext of marriage. 4. The petitioner is in jail since 14.01.2025 and it has been submitted by the learned counsel for the petitioner that the petitioner is innocent and the FIR has been registered after a Patna High Court CR. MISC. No.36404 of 2025(2) dt.18-06-2025 2/2 delay of 21 days. He also submits that the victim is a major under the Muslim Law and it appears to the a case of consensual sex. 5. Learned counsel for the informant has vehemently opposed the application of the petitioner for grant of bail. 6. Considering the aforesaid facts, this application is allowed. 7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-VI-cum- Special Judge, POCSO, Gopalganj/concerned Court below in connection with Kateya P.S.
