1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).
2. This is a 2nd successive bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Attabira P.S. Case No.288 of 2023 corresponding to C.T. Case No.45 of 2023 pending in the file of learned ADJ-cum-Special Court under POCSO Act, Bargarh, for commission of offences punishable U/Ss. 363/376(2)(n)/376(3) of the IPC read with Sec.6 of POCSO Act, on the allegation of kidnapping the victim and committing rape and aggravated penetrative sexual assault upon her.
3. Heard, Mr. Kuldeep Mohanty, learned counsel for the petitioner, Mr. M.R. Patra, learned Addl. PP and Mr. Bijay Kumar Behera, learned counsel, who enters appearance for the informant in Court today
by filing Vakalatnama which is taken on record, in the matter and perused the record including the evidence of the victim. At the outset, Mr. Mohanty submits that this is the 2nd bail application of the petitioner, but no bail application of the petitioner is pending before any other forum except this one.

After having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioner vis-à- vis the accusations sought to be brought against him and on going through the materials placed on record together with the evidence of the victim as produced, this Court considers that the petitioner has made out a case for grant of bail.
5. Hence, the bail application of the Petitioner stands allowed and the Petitioner is allowed to go on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty-five Thousand) only with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deems fit and proper by it.
6. Accordingly, the BLAPL stands disposed of.
7. Issue urgent certified copy of the order as per Rules.
